1.1 This policy concerning our processing of personal data, hereinafter referred to as the “Privacy Policy”, describes how Virkplan ApS collects and processes information about you.

1.4 This Privacy Policy applies to all personal data that you provide to us or that we collect via our website, hereinafter referred to as the “Website”.
1.5 Virkplan ApS is the data controller for the personal data we collect about you.
2.1 What personal data do we collect?
2.1.1 When you visit our Website, we automatically collect information about you, including which browser you use, which search terms you use on the Website, which pages you visit, your IP address, and information about your device.
2.1.2 When you purchase a product or service from us, we collect personal data such as name, address, email address, phone number, IP address, and information about purchased or returned products.
2.2 Purposes of processing?
2.2.1 The personal data collected under clause 2.1.1 is used to improve the Website, optimize user experience, and support targeted marketing.
2.2.2 The personal data collected under clause 2.1.2 is used to deliver products or services, fulfill contractual obligations, and comply with accounting and legal requirements.
2.3 Legal basis for processing?
2.3.1 The processing of personal data under clause 2.1.1 is based on our legitimate interest in improving the Website and offering relevant content.

2.5.3 Virkplan ApS does not receive personal data from third parties unless requested by you in connection with data portability.
3.1 We sometimes use external companies to assist with, among other things, the technical operation of the Website, as well as to carry out targeted marketing, including retargeting, evaluation of purchase processes, and improvements to the Website. Some of these external companies are independent data controllers for the data that is disclosed to them. The basis for this disclosure is a balancing of interests between Virkplan ApS’ interests and the user’s interests. This means that personal data is not disclosed if the customer’s interests outweigh Virkplan ApS’. In addition, Virkplan ApS has entered into agreements on the disclosure of data to external companies for the purpose of fulfilling the contract. This may, for example, include GLS in relation to delivery under a dropshipment agreement.
3.2 Other external companies are data processors subject to our instructions. They process data on our behalf, and Virkplan ApS is therefore responsible for ensuring that the data processors do not use the data they receive from us for purposes other than fulfilling the agreement entered into with us. All of our data processors have entered into written data processing agreements with us, which set out guidelines for what they may and may not use the transferred data for.
3.3 One of these data processors, Google Analytics by Google Inc., is established in the United States, and the necessary safeguards for the transfer of data to the United States are ensured through the data processor’s certification under the EU–U.S. Privacy Shield. 3.4 For the purpose of improving the purchase process, the provided email address is used to send a separate email requesting a review of Virkplan ApS and the purchase and delivery services of the shipping company used.
4.1 We seek, as far as possible, to ensure transparency regarding our processing of your personal data, and in this context, as the data controller, we must inform you of your rights.
4.2 Documentation
4.2.1 As part of our efforts to enhance the general level of data security, we require documentation before processing a request in which you exercise the rights mentioned in sections 4.3–4.9.
4.2.2 When contacting Virkplan ApS regarding the deletion of personal data, you must go through an identification process before the personal data is deleted. This involves sending you a PDF document, which you are asked to sign personally and then return either in physical form or as a scanned document.

4.2.3 If the request concerns the other rights listed below, it will be sufficient for the request to be sent from the registered email address. The request should be sent by email to kontakt@virkplan.dk. If the originally registered email address is no longer available, reference is made to the documentation requirement in section 4.2.2.
4.3 Right of access
4.3.1 You are at any time entitled to request information about which personal data we have registered about you, the purpose of the processing, and which data processors we use in connection with the processing.
4.3.2 This right may be exercised by generating an automatic report. This is done by contacting Virkplan ApS, which will send an email containing your personal data to you.
4.4 Right to rectification
4.4.1 You have the right to have inaccurate personal data concerning you corrected by us. If you become aware that the information we have registered about you is incorrect, you are encouraged to contact us in writing so that the information can be corrected.
4.4.2 Information collected in connection with the creation of your customer account can be corrected by you via login to your customer account under the section “My profile”.
4.4.3 With regard to documentation, reference is made to section 4.2.
4.5 Right to erasure
4.5.1 In certain cases, you have the right to have your personal data deleted by us. To the extent that your data is necessary, for example to comply with our accounting obligations, we are not obliged to delete your personal data. The same applies if the data is required to establish, exercise, or defend a legal claim.

4.6 Right to restriction of processing
4.6.1 In certain cases, you have the right to restrict the processing of your personal data to storage only, for example if you believe that the data we process about you is inaccurate.

4.7.1 You have the right to receive your personal data in a structured, commonly used, and machine-readable format and have the right to transmit this data to another data controller when we collect your personal data in connection with your purchase of a product from us.

4.8.1 You may at any time object to our processing of your personal data collected for the purpose of improving the functions and structure of the Website, if you have particular reasons for doing so.

4.10 Right to lodge a complaint
4.10.1 You have the right at any time to lodge a complaint with the Danish Data Protection Agency, Borgergade 28, 5th floor, 1300 Copenhagen K, regarding our processing of your personal data.
5.1 Personal data that we register about you through our Website is, as a general rule, stored for 5 years if there is no activity on the account. Activity is defined as a purchase being made, information being changed, or a login taking place. The customer account is therefore only deleted if the account has been inactive for 5 years.
5.2 All invoices are stored for 5 years from the end of the financial year in accordance with the Danish Bookkeeping Act. After 5 years, all invoices are anonymized.
5.3 All purchase information is automatically deleted after 5 years.
5.4 Information collected in connection with your consent to receive newsletters is deleted if you withdraw your consent, cf. section 4.8.
